Welcome to Pictoria ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Pictoria mobile application ("App") and related services.

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

Pictoria is an AI-powered mobile application that provides:

• AI-powered image editing and enhancement
• Avatar creation and transformation tools
• Photo editing features including colorization, enhancement, and retouching
• Art style transformations (cartoon, anime, oil painting, etc.)
• Background removal and replacement
• Portrait editing features (hairstyle, makeup, smile enhancement)
• Image generation capabilities

3. Account Registration and Eligibility

3.1 Age Requirements

You must be at least 13 years old to use our App. If you are under 18, you must have parental or guardian consent to use our services.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You are responsible for all activities that occur under your account

4. User Content and License

4.1 Your Content

• You retain ownership of images and content you upload to the App
• You grant us a limited, non-exclusive license to process your images using our AI services
• You represent that you have the right to upload and process the images you submit

4.2 Generated Content

• AI-processed and generated images remain your property
• You may use generated content for personal and commercial purposes
• We reserve the right to use anonymized and aggregated data to improve our services

4.3 Content Restrictions

You may not upload content that:

• Contains nudity, pornography, or sexually explicit material
• Depicts violence, harassment, or illegal activities
• Violates intellectual property rights of others
• Contains malware or harmful code
• Is defamatory, discriminatory, or hateful

5. Subscription and Payment Terms

5.1 Credit System

• Pictoria operates on a credit-based system
• Credits are consumed for AI processing operations
• Credit balances are non-transferable and non-refundable

5.2 In-App Purchases

• Prices are clearly displayed before purchase
• All sales are final unless otherwise required by law
• We use secure third-party payment processors

5.3 Refunds

Refunds may be provided in accordance with Apple App Store policies and applicable law.

6. Prohibited Uses

You may not:

• Use the App for illegal purposes
• Attempt to reverse engineer or hack the App
• Interfere with the App's operation or security
• Create accounts using automated means
• Violate intellectual property rights
• Generate deepfakes or misleading content without proper disclosure

7. Intellectual Property

• The App and its original content are protected by intellectual property laws
• Our trademarks, service marks, and logos are our property
• AI models and algorithms remain our proprietary technology

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE.

9. Termination

You may terminate your account at any time by contacting us or deleting the App.

We may terminate or suspend your account for:

• Violation of these Terms
• Illegal activity
• Non-payment of fees
• Extended inactivity

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through in-app notifications, email notifications, or App Store update notes. Continued use after changes constitutes acceptance of new Terms.
